Welcome to thefinigangroup.com (the "Site"), operated by The Finigan Group, a real estate team affiliated with eXp Realty ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our Site and services. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to enter into a legally binding contract to use this Site. By using the Site, you represent that you meet these requirements.

2. Our Services

We provide real estate marketing and brokerage services in North Carolina and surrounding markets, including:

  • Property search tools and MLS-sourced listing information

  • Home valuation tools, instant offer requests, and seller resources

  • Buyer resources, including the Charlotte Relocation Guide

  • Educational content, videos, and market commentary

The Site and its tools are informational. Use of the Site does not, by itself, create an agency or client relationship between you and The Finigan Group, eXp Realty, or any of our agents. A real estate agency relationship is established only by a separately signed written agreement.

3. North Carolina Agency Disclosure

In North Carolina, real estate agents are required to provide the "Working with Real Estate Agents Disclosure" at first substantial contact with a prospective buyer, seller, tenant, or landlord. Use of this Site does not satisfy that requirement. Please review the disclosure with your agent before discussing confidential information.

4. Property Information; "Deemed Reliable but Not Guaranteed"

Listing information on the Site is provided by the Multiple Listing Service (MLS), public records, third-party data providers, and our own brokerage. While we work to keep the information accurate and current:

  • Property details, prices, square footage, lot size, school zones, and availability may change without notice.

  • All information is deemed reliable but not guaranteed and should be independently verified.

  • We are not responsible for typographical errors, misinformation, or misprints.

  • Property listings are subject to prior sale, change, or withdrawal.

You should rely on professional inspections, your own due diligence, and licensed professionals (attorneys, inspectors, appraisers, lenders) before making any real estate decision.

  • Use the Site to compete with our brokerage or solicit our clients

7. Intellectual Property

All content on the Site — including text, graphics, logos, photography, video, design, and "The Finigan Group" name and marks — is owned by us or our licensors and is protected by U.S. and international copyright, trademark, and other laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent, except as expressly permitted in these Terms.

MLS listing data is owned by the applicable MLS and its participants and is provided under license. Use of MLS data is subject to the rules of that MLS.

8. User Submissions

If you submit any information, comments, reviews, or content to us through the Site (including through forms, email, or testimonials), you grant The Finigan Group a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute that content in connection with our business. You represent that you have the right to share the content and that it does not violate the rights of any third party.

9. Third-Party Links and Services

The Site may contain links to third-party websites, MLS portals, lenders, title companies, and other partners. We are not responsible for the content, policies, or practices of those third parties. Linking to a third-party site does not imply endorsement.

10. Disclaimers

THE SITE AND ALL CONTENT, TOOLS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that:

  • Property information, valuations, or market data are accurate or complete

  • Home value estimates reflect actual market value (they are estimates only)

  • Any communication you submit will receive a response within a specific timeframe

Home valuation tools and "instant offer" estimates are computer-generated approximations and are not appraisals or formal opinions of value.

11. Limitation of Liability

To the maximum extent permitted by law, The Finigan Group, eXp Realty, our agents, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.

Our total cumulative liability arising out of or relating to these Terms or the Site shall not exceed one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless The Finigan Group, eXp Realty, and our agents and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any third party's rights.

13. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the personal jurisdiction of those courts.

14. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

15. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated by posting an updated version on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
